Terms & Conditions

1. Agreement

These Terms & Conditions govern all purchases, quotations, and inquiries made through giftsgulf.com and any direct commercial relationship with Gifts Gulf (Doha, Qatar). Placing an order or requesting a quote constitutes acceptance of these terms.

2. Who may order

Gifts Gulf primarily serves businesses, resellers, and institutional buyers. You confirm that you are at least 18 years old and authorised to enter into binding agreements on behalf of the account holder.

3. Quotes and orders

• Quotes are valid for 30 days unless otherwise stated. Prices and lead times may change after expiry.
• Orders are considered confirmed only when we send you an order confirmation email with an order number (format: GG-YYYY-XXXX).
• Minimum order quantities (MOQs) and bulk tiers are shown on each product page. We reserve the right to decline or adjust orders that don't meet the stated MOQ.
• We may cancel orders where pricing was displayed in error; in that case we refund any amount paid in full.

4. Pricing, VAT & duties

• Prices shown are in your selected display currency and exclude taxes unless stated otherwise.
• VAT / GST is applied at checkout based on your shipping country, at the prevailing statutory rate (currently 0% Qatar, 5% UAE, 15% Saudi Arabia, 18% India default, 20% UK, etc.).
• For cross-border EU B2B orders, we apply reverse-charge when your VAT number validates against VIES.
• Import duties, customs fees, and any local taxes on delivery are the buyer's responsibility unless we've agreed DDP terms in writing.

5. Customization & artwork

• You retain ownership of any logos, brand artwork, or reference files you upload. By uploading them you grant us a non-exclusive licence to reproduce them on the purchased items.
• You warrant that you have the right to use and reproduce all artwork you send us. You agree to indemnify Gifts Gulf against any third-party IP claim arising from artwork you supplied.
• We'll send a digital proof for approval before production on customized orders. Once approved and production begins, artwork changes are not possible and no refunds for proof-approved customization are available.
• Colour may vary slightly between digital proofs and physical prints. A variance of ±10% in ink colour is considered within tolerance.

6. Payment

• We accept card/UPI/netbanking via Razorpay, bank transfer, and (in GCC countries) cash on delivery.
• Bulk orders typically require a 50% advance before production, with the balance due before shipment. Specific terms appear on each quote.
• Overdue invoices accrue interest at 1.5% per month or the maximum permitted by applicable law, whichever is lower.
• We reserve the right to suspend service on accounts with overdue balances.

7. Shipping & delivery

Delivery timelines, shipping methods, and carrier rates are detailed in our Shipping Policy. Estimated dates are provided in good faith and are not guaranteed; we are not liable for courier delays outside our control.

8. Returns & refunds

Returns are governed by our Returns Policy. In short: defective/incorrect items are fully refundable within 14 days of delivery. Customized items are non-returnable unless the defect is our fault.

9. Warranties

• We warrant products will be free from material manufacturing defects for 30 days from delivery (or the manufacturer's warranty, whichever is longer).
• Beyond that, products are provided "as is" with no implied warranties of merchantability or fitness for a particular purpose except as required by applicable consumer-protection law.

10. Limitation of liability

To the maximum extent permitted by law, Gifts Gulf's total liability for any claim arising from an order shall not exceed the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages (including lost profits, lost sales, or reputational harm) even if advised of their possibility.

11. Intellectual property

All site content, product photography, copy, logos, and the "Gifts Gulf" mark are our property or licensed to us. You may not copy, redistribute, or use them for commercial purposes without written permission.

12. Accounts and security

You are responsible for keeping your account password confidential and for all activity under your account. Notify us immediately at security@giftsgulf.com if you suspect unauthorised use.

13. Prohibited use

You agree not to:

• Submit artwork or content that infringes third-party IP, is defamatory, hateful, or unlawful.
• Attempt to probe, scan, or test the vulnerability of our systems without written authorisation.
• Use our site to distribute malware or engage in fraud.
• Scrape product data or pricing without written permission.

14. Governing law & jurisdiction

These terms are governed by the laws of Qatar. Disputes shall first be attempted in good faith through negotiation, and if unresolved, submitted to the competent courts of Doha. Nothing here affects rights you may have under mandatory consumer-protection law in your country of residence.

15. Changes

We may revise these terms. Material changes take effect 30 days after we post them here (earlier for changes mandated by law). Continued use of our services after that date constitutes acceptance.
